§ 11-03-020. Cruelty to children.

  • (a)

    Cruelty to children consists of any parent, guardian or other person having care or custody of any child:

    (1)

    Intentionally causing or permitting:

    a.

    The life of such child to be endangered; or

    b.

    The health of such child to be injured; or

    c.

    The morals of such child to be impaired.

    (2)

    Intentionally placing such child in a situation where:

    a.

    The life of such child is endangered; or

    b.

    The health of such child is injured; or

    c.

    The morals of such child is impaired.

    (3)

    Wilfully torturing, tormenting or cruelly punishing or injuring such child; or

    (4)

    Wilfully or negligently depriving such child of necessary food, clothing or shelter.

    (b)

    It shall be unlawful for any person to commit the offense defined in this section.
