§ 11-04-025. Possession of drug paraphernalia prohibited.

  • It shall be unlawful for any person to use or possess with intent to use drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body a controlled substance in violation of the Controlled Substances Act as set out in Chapter 30, Article 31 (N.M.S.A. 1978). The provisions of this section do not apply to a person who is in possession of hypodermic syringes or needles at a time the person is directly or immediately engaged in a harm reduction program as provided in the New Mexico Harm Reduction Act, Chapter 24, Article 2C (N.M.S.A. 1978).
