§ 11-05-140. Generally—Impersonating a peace officer.

  • (a)

    Impersonating a peace officer consists of any person:

    (1)

    Without due authority exercising or attempting to exercise the functions of any peace officer; or

    (2)

    Falsely assuming or pretending to be a peace officer, sheriff, magistrate or coroner with intent to deceive another; or

    (3)

    Wearing or carrying the uniform, apparel, badge, identification card, or other insignia of office, or any kind or type of reproduction made to resemble or appear like any insignia of office, adopted for the exclusive use of duly commissioned peace officers.

    (b)

    It shall be unlawful for any person to commit the offense defined in this section.
