§ 12-05-070. Appropriate procedures to be followed.

  • It shall be unlawful for any person to drive or cause to be driven, operate or maintain any motor vehicle, truck, trailer or any other vehicle having thereon or attached thereto, a tank or other receptacle used for the transporting of any hazardous cargo over any street, highway or alley other than as provided above.

    Traffic will be temporarily re-routed onto White Sands Boulevard if the Highway 54 Relief Route is determined by the NM State Police, NM State Highway Department or the Alamogordo police department, to be impassible.

    Except for transporters making pick-ups or deliveries or requiring food, lodging, fuel or other services, it shall be unlawful for any person to park or cause to be parked or to maintain any motor vehicle, truck, trailer, or any other vehicle containing hazardous cargo on any highway, street, alley, public place or at any place along the primary or secondary hazardous cargo routes. This shall not apply to the stopping of any vehicle at a repair facility due to breakdown occurring on the designated streets or highways of the primary or secondary routes. Under these circumstances, the vehicle shall not remain at the service station or garage longer than thirty (30) minutes unless the department of public safety is notified of the same.

    Trouble causing forced stoppage; conditions allowing repairs on street: When any truck, trailer, motor vehicle or any other form of vehicle used for transporting any hazardous cargo has mechanical problems, experiences a flat tire, needs repairs, needs fuel for its own propulsion to the extent that it cannot be propelled with its own power, then the necessary repairs can be made where the vehicle has been forced to stop, provided the vehicle can be repaired within a period of two (2) hours. The driver of the vehicle shall immediately notify the department of public safety regarding the forced stoppage.

    Mechanical problems requiring towing; police direction: When any truck, trailer, motor vehicle or any other form of vehicle containing any hazardous cargo has broken down and is in need of repairs to the extent that the vehicle cannot be repaired within two (2) hours, the department of public safety shall be notified immediately. Notice shall be given that the vehicle is being removed from the place of stoppage or breakdown to a garage or some other repair facility and if necessary, shall be moved under the direction of the department of public safety.
