§ 14-01-010. Definitions.

  • For the purposes of this chapter, the following terms, phrases, words and their derivatives shall have the meaning given below.

    Code enforcement officer is the city official charged with enforcement of this chapter and other provisions of this Code relating to public health, or his/her authorized deputy.

    Commercial account is any account which is not a residential account.

    Contractor is the private refuse collection contractor to whom the city has awarded a contract for the collection and hauling of the city residential solid waste.

    Convenience Center Fee is a fee applied to all residential accounts including residential customers using waste containers other than those provided by the city's franchise for waste collection services and is used to offset the cost of operating the convenience center on LaVelle Road in the city.

    Debris is all waste building material, bricks, concrete blocks, trees, tree limbs and other matter which is commonly known as debris.

    Garbage is putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.

    Hauler is any person, joint enterprise or corporation who collects refuse, garbage or debris from any property not owned by the person, joint enterprise or corporation.

    Interested parties means a property owner, resident, tenant, or person in possession or in control of the property.

    Litter is refuse, garbage or debris found in public areas or generated while traveling in a motor vehicle.

    Notice means any method of communication reasonably calculated to inform interested parties that a violation of ordinance is observed and includes, but is not limited to: in-person notification, posting a notice on property and notification via U.S. Mail.

    Property owners mean the record holder of legal title as shown by the official records of the County of Otero unless there exists a contract purchaser of record, in which case it means the contract purchaser.

    Refuse is all solid waste (except body wastes), including garbage, paper, cardboard, tin cans, yard clippings, leaves, wood, glass; also liquid petroleum waste, such as motor oil; and all such similar items.

    Residential account is an account for any housing area with not more than four (4) houses or family units on one (1) water meter. This term is different from the term "residential customer" and is intended only to distinguish the number of units in a housing area that are not subject to commercial account collection rates.
