§ 17-01-020. Definitions.

  • Unless the context clearly indicates that a different meaning is intended, the words and phrases used in this chapter shall have the following meanings:

    Amusement hall: Any arcade, building or premises having as its primary business the providing of mechanical or electronic amusement devices, including but not limited to the following: Pinball machines, electronic or video games of skill or chance, claw or scoop machines, jukeboxes or coin-operated table games.

    Business: Any profession, trade or occupation and all and every kind of calling, whether or not carried on for profit, except those organizations exempt from the federal income tax pursuant to Section 501(c)(3) of the United States Internal Revenue Code, as amended or renumbered; provided, however, "business" shall include an "unrelated trade or business" of such organizations as the latter terms are defined in Section 513 of the United States Internal Revenue Code of 1954, as amended or renumbered.

    Conduct, carry on: To engage in, carry on, own, maintain, manage or operate any business, trade, art, profession, calling, employment, occupation or any commercial, industrial or professional pursuit, vocation or enterprise in this city.

    Outdoor displays and sales: The display or sale of goods or merchandise not in or from an enclosed permanent building. This term shall not apply to:

    (1)

    Special sales, not more than two (2) days in duration, conducted by a merchant from or adjacent to the building which is its normal place of business; or

    (2)

    Sales at fairs, fiestas, art shows and similar events sponsored by civic or charitable organizations.

    These sales shall nevertheless be subject to registration, as provided in section 17-01-030.

    Place of business: Any location, building or portion thereof, or premises in which or from which a business is carried on. The term includes, but is not limited to, an office, warehouse, yard, location where books and records are kept, or the location from which business is solicited.
