§ 17-07-100. Powers and duties of licensees.

  • The powers and duties of all persons licensed under the provisions of this article shall consist of:

    (1)

    Obeying the orders of the director of public safety insofar as the duties and responsibilities of a special policeman or private detective are concerned.

    (2)

    Being permitted to carry arms only when on duty and in compliance with the requirements established by the director.

    (3)

    Obeying and complying with all the rules and regulations of the police department of the city so far as same may be applicable.

    (4)

    A special policeman when on patrol or guard duty must wear proper uniform. Such uniforms shall all be identical and shall be of a different color than those worn by the police department; provided, however, plant guards and those employees who are engaged in the protection of any employer's own property or products may wear a uniform of their own choice, color or design. Badges must be different than those of city, county or state police officers.

    (5)

    Any special policeman or private detective having knowledge of a felony shall immediately notify the police department and the county sheriff's office and stand by until regular police officers arrive. At no time shall he conduct any investigation before calling the police department. During an investigation of any crime, the police department reserves the right to stop a special policeman or private detective, whether local or foreign, from interfering in any way with the police department.
