§ 22-01-030. Procedure for conditional approval.

  • (a)

    Conditional approval procedure (not mandatory). Previous to the filing of an application for street, utility and grading (SUG) approval, the subdivider may submit a general subdivision plan. The subdivider may submit to the planning authority an application and four (4) prints of the following plans and data: (No fee is required.)

    (1)

    General subdivision information should describe or outline the existing conditions of the site and the proposed development. This information should include land characteristics and available community facilities and utilities; and information describing the subdivision proposal such as number of residential lots, typical lot width and depth, and proposed utilities and street improvements.

    (2)

    Location map should show the relationship of the proposed subdivision to existing community facilities, which serve or influence the subdivision. Include development name and location, main traffic arteries, public transportation lines, shopping centers, elementary and high schools, parks and playgrounds, other community features such as railroad stations, airports, hospitals and churches, title, scale, north arrow and date.

    Sketch plan on topographic survey if publicly available should show in simple sketch form the proposed layout of streets, lots and other features in relation to existing conditions. The sketch plan may be a free hand pencil sketch made directly on a print of the topographic survey. The sketch plan may also include the existing topographic data listed under this chapter, plats and data for conditional approval, if the subdivider wishes to present such detail at this stage.

    (b)

    Within fifteen (15) working days the planning authority shall inform the subdivider that the plans and data as submitted or as modified do or do not comply with the city comprehensive plan, zoning regulations, or meet the objectives of these regulations. When the planning authority finds the plans and data do not meet the objectives of these regulations it shall express the reasons therefor.
