§ 24-13-020. Parking at businesses for persons with mobility disabilities.

  • (a)

    The determination to post the curb area adjacent to a business with "Parking Designated for Persons with Mobility Disability" signs shall be made by the city commission, after good cause is shown by the applicant. Good cause must include a statement that the applicant's business does not have off-street parking available or an off-street parking space that could be used for parking for persons with mobility disabilities.

    (b)

    The application will be accompanied by an application fee of fifty dollars ($50.00) to defray the costs of investigating the application and giving notice in accordance with this ordinance.

    (c)

    In determining whether or not to authorize a sign in accordance with this section, the commission will consider the likelihood that the parking space will serve more than one person and whether the need of the business for the space is likely to be on-going.

    (d)

    Before an application to post a sign according to this section can be considered by the city commission, the planning division will give notice of the application to all property owners within a 200-foot radius of the requesting business at least ten days prior to the meeting.

    (e)

    A fee of one hundred dollars ($100.00) for the sign shall be paid to the city treasurer upon approval of each application.

    (f)

    The city commission will review signs placed in connection with this ordinance at the same time and in the same manner with which it reviews signs placed in accordance with section 24-01-080.
