§ 28-03-087. Abatement of penalties and late fees.

  • (a)

    Any person who incurs a penalty or late fee in the payment of a regularly charged utility bill to the city by reason of activation or deployment in the armed services of the United States may request that the penalty or late fee be waived. Waiver of the fees or penalties is dependent upon the requesting party showing adequate proof of activation or deployment. Any fee or penalty to be waived must have occurred in the billing period immediately preceding the activation or deployment.

    (b)

    The city manager and finance director may waive a penalty, late fee or interest for extraordinary circumstances provided such circumstances are documented in the customer's account and that no more than one (1) waiver is granted per account in any twelve (12) consecutive billing periods.
