§ 2-03-440. Personnel Systems—Labor Relations (Collective Bargaining)—Applicability.

  • This subdivision shall preempt all contrary local ordinances or executive orders except the city charter and those provisions of the personnel ordinance, rules or regulations establishing:

    (1)

    Classified and unclassified service;

    (2)

    Performance evaluations;

    (3)

    Methods of initial employment and promotion procedures;

    (4)

    Grievance and appeal procedures for classified employees; and

    (5)

    Other provisions of the personnel ordinance, rules and regulations which do not conflict with this subdivision, or a collective bargaining agreement which has been ratified and approved by the governing body shall be administered in conjunction with this subdivision. All provisions of the personnel ordinance shall continue in effect for all employees not represented by a bargaining agent.
