§ 2-13-100. Competitive sealed bids.

  • (a)

    All purchases of goods, services and construction in excess of sixty thousand dollars ($60,000.00) shall be made by competitive sealed bid except those purchases made pursuant to the following sections of the city purchasing ordinance:

    (1)

    Section 2-13-080, small purchase requirements.

    (2)

    Section 2-13-090, purchases by written quotation.

    (3)

    Section 2-13-110, competitive sealed proposals.

    (4)

    Section 2-13-140, sole source purchases.

    (5)

    Section 2-13-160, special purchase methods.

    (b)

    After submission of a completed purchase request (requisition) to the purchasing office by the user, purchases by competitive sealed bid shall be made by an invitation for bids, in accordance with the provisions set out in section 2-13-220, notice of purchase. In addition, the following provisions shall apply:

    (1)

    Offers shall be publicly opened according to such procedures as may be adopted by the central purchasing manager.

    (2)

    Offers shall be evaluated based on the requirements set forth in the invitation for bids, which may include criteria to determine acceptability such as inspection, testing, quality, workmanship, delivery, and suitability for a particular purpose. Other criteria may be developed and used depending on need, requirements of the user, or the nature of the bid.

    (3)

    The purchasing manager may accept a lower total offer from the awarded offer or to an invitation for bids, if said offer has otherwise qualified, and if there is no change in the original terms and condition of the invitation for bids.

    (4)

    Separate purchases of the same or similar goods, services or construction from the same or different businesses at or about the same time shall be considered a single purchase for purposes of this section.
