§ 2-13-260. Approval of purchases/signature authority.

  • (a)

    The following purchases must be approved by the city commission:

    (1)

    All purchases of goods or construction for amounts exceeding sixty thousand dollars ($60,000.00) except those purchases made within budget for projects previously approved by the commission and made through a government contract pursuant to section 2-13-150, procurement under existing contracts;

    (2)

    All purchases of services for architects or engineers for public works projects in amounts exceeding sixty thousand dollars ($60,000.00); or landscape architects or surveying services exceeding ten thousand dollars ($10,000.00);

    (3)

    All purchases of other professional services in amounts exceeding sixty thousand dollars ($60,000.00).

    (b)

    Signatory authority for executing city contracts.

    (1)

    City manager. The city manager is authorized to award and sign contracts for goods, services and construction without prior council approval in an amount not in excess of sixty thousand dollars ($60,000.00) provided that the services and funds were approved by the city commission as part of the annual department budget and any contract authorized by the city commission unless the commission directs some other officer or officers to sign on behalf of the city.

    (2)

    Department directors. Department directors are authorized to award and sign contracts for goods, services and construction without prior city manager or commission approval in an amount not in excess of twenty thousand dollars ($20,000.00) provided that the goods, services and construction and funds were approved by the city commission as part of the annual department budget. This authority may not be delegated below the department director level.

    (3)

    City attorney. The city attorney is authorized to award and sign contracts for all services for outside counsel and experts related directly to and necessary for prosecution and defense of pending litigation, and for services for outside counsel and experts necessary to address other pending or potential legal claims or legal issues so long as funds for outside counsel, experts and related legal services were approved by the city commission as part of the approved annual budget. The city attorney shall keep commission informed regarding any such expense that exceeds sixty thousand dollars ($60,000.00) on not less than a quarterly basis and shall seek budget updates, if needed, within a timely fashion.
