§ 32-01-030. Sales by public bid.

(a)

Before any property is sold by public bid, a notice shall be published at least twice, as provided in subsection J of Section 3-1-2 NMSA 1978, not less than seven (7) days apart, with the last publication not less than seven (7) days before the sale. The notice shall contain:

(1)

The date, time and place of the sale;

(2)

Whether sealed bids will be submitted in advance of the sale or whether bids will be made at public auction;

(3)

Legal description of the property to be sold;

(4)

Minimum bids, if any;

(5)

The value of any appraisals on the property.

(b)

The bid of the highest responsible bidder shall be accepted, unless the terms of the bid do not meet the published terms and conditions of the sale.

(c)

The city may reject all bids.
