§ 33-01-060. Nonexclusive franchise.

    Any franchise granted shall be nonexclusive. The grantor specifically reserves the right to grant, at any time, such additional franchises for a cable television system or any component thereof, as it deems appropriate, subject to applicable state and federal law, provided that if the grantor grants an additional franchise on terms more favorable to the second grantee (whether by the grant of greater benefits or the imposition of lesser obligations), then the initial grantee shall have the right to renegotiate its franchise to incorporate the more favorable terms, with any such incorporation to take effect within sixty (60) days of the effective date of the additional franchise.

    B.

    If grantor grants any additional cable television franchise, grantor shall require the additional grantee to indemnify grantee against any incremental inspection, make-ready, or construction costs resulting from the additional grantee's construction of its cable system facilities.
