§ 33-01-360. Extended operation and continuity of services.

  • Upon expiration or revocation of the franchise, the grantor shall have the discretion to permit grantee to continue to operate the cable television system for a transitional period of time of at least ninety (90) days. After the ninetieth day, grantee, upon providing grantor with thirty (30) days written notice, may elect to discontinue operating the cable system. During the transitional period, grantee shall continue to operate the system under the terms and conditions of this chapter and the franchise and to provide the regular subscriber service and any and all of the services that may be provided at that time. It shall be the right of all subscribers to continue to receive all available services provided that financial and other obligations to grantee are honored. The grantee shall use reasonable efforts to provide continuous, uninterrupted service to its subscribers.
