§ 4-04-040. Aeronautical advisory station (UNICOM) operation.

  • (a)

    The airport manager shall assign operation of the UNICOM system to authorized fixed base operators providing service to local and transient aircraft. Operation shall be assigned on an equal basis with regular rotation, but the airport manager may vary the rotation if he determines it necessary to protect the city's license or for reasons of safety.

    (b)

    Operators authorized by the city to operate the UNICOM system shall be familiar with and abide by all rules and regulations promulgated by the Federal Communications Commission relating to the use and operation of an aeronautical advisory station. Failure to comply with current rules and regulations of the FCC or of the city shall be grounds for the city and/or the airport manager to terminate the operator's authority to operate the UNICOM.

    (c)

    Operators of the UNICOM system shall comply with the following requirements:

    (1)

    Only one transmitter shall communicate at any given time in accordance with FCC regulations.

    (2)

    Non-public service shall be provided to any private aircraft upon request and without discrimination.

    (3)

    Information provided with respect to available ground services shall be complete, accurate and impartial. Aircraft shall not be directed to a specific facility unless the pilot so requests.

    (4)

    Communications on the UNICOM shall be limited to information necessary for safe and expeditious operation of aircraft, such as condition of runways, types of available fuel, wind and weather conditions and response to pilot requests.

    (5)

    UNICOM operators shall not specifically solicit business.

    (6)

    Fixed base operators who do not have control of the UNlCOM at that time may respond to transmissions only when:

    a.

    The transmission is specifically directed to that operator by name;

    b.

    There have been two (2) unanswered calls by the same aircraft; or

    c.

    That operator is the only fixed base operator available who is certified by the National Weather Service to provide data pertaining to ceiling, visibility and altimeter setting during periods when instrument flight rules are in effect.

    (d)

    The airport manager shall monitor UNICOM operations from time to time and may take reasonable steps to ensure compliance with these requirements, including initiation of Code violation process and suspension of an operator's authority to operate under the city's UNICOM license.
