§ 5-01-050. Drinking in public places.

A.

Drinking in public places consists of drinking or consuming alcoholic beverages (as the term is defined in Section 60-3A-3 NMSA 1978, (as amended) in any public place, private club, key club, whether operated for profit or not, or on a parking lot adjacent to an establishment licensed to dispense alcoholic beverages; provided, that this chapter shall not apply to drinking inside an establishment having a license to dispense alcoholic beverages or a Temporary Alcoholic Beverage Dispenser's location as authorized by Section 5-01-035 of the Code of Ordinances.

B.

It shall be unlawful for any person to commit the offense defined in this section.
