§ 8-07-040. Obstruction on sidewalks.

  • (a)

    All sidewalks shall be kept clean from rocks and other obstructions, including ice and snow, by the owner, occupants or agents in charge of the abutting property.

    (b)

    All areas directly over sidewalks, to a height of eight (8) feet shall be maintained free of vegetation or other obstruction by the owners, occupants or agents in charge of the abutting property.

    (c)

    The area between the back of curb and the property line and all plantings therein shall be maintained by the owners, occupants or agents in charge of the abutting property.

    (d)

    No item which would obstruct pedestrians or effectively reduce the width of a sidewalk shall be placed in, on, over or under the sidewalk.

    (e)

    When it has been determined that there is a violation of the provisions of this section, notice shall be served by the City Code Enforcement Supervisor or designee upon the owners or agents in charge of the property adjoining such sidewalk or sidewalk setback area, directing that removal of the obstruction be made within a designated period of time, which shall not be more than thirty (30) days. If the owners of the property fail to comply with such order within the time prescribed, the City shall cause the removal of the obstruction to be made at the cost and expense of such owners of the property and the cost of such removal of the obstruction shall constitute a lien against such property and shall be foreclosed in the same manner provided by law for the foreclosure of municipal liens.

    (f)

    Failure to comply with the order as provided for herein shall be deemed a violation of this Code. The remedies provided in this section are cumulative. Nothing in paragraph (e) of this section shall preclude the filing of an ordinance violation citation for a violation of this section.
