§ 8-08-140. Revocation of certification.

  • All certifications for backflow prevention testers and backflow prevention repair persons shall be subject to revocation by the city.

    (1)

    The city building code division may revoke certification of any certified backflow prevention assembly tester or certified backflow prevention assembly repair person:

    a.

    Who fails to comply with the provisions of this article; or

    b.

    Who falsifies tests, records or report; or

    c.

    Who fails to submit copies of test reports to the building code divisions; or

    d.

    Who fails to properly maintain test equipment; or

    e.

    Who alters an existing backflow prevention assembly without approval of the building code division.

    (2)

    Any person who falsifies backflow prevention assembly tests, records and reports shall be subject to the penalties provided within this article.

    (3)

    The building code division shall advise the certified backflow prevention tester or certified backflow prevention repair person in writing of the revocation of certification, and include the cause thereof. The certificate holder may appeal the decision and request a hearing before the code official. Said request must be filed in writing with the building code division within ten (10) days of the mailing of notification of revocation. Said hearing shall be scheduled within three (3) working days of the receipt of the request for hearing by the building code division. The building official may enforce the original decision, or overturn the decision. Any action to overturn may include probationary periods in which no further issues of violations may take place. If the building official reaffirms the original decision to revoke certification, the building official shall notify the certificate holder through certified mail service. Said letter to be mailed within three (3) working days of the date of the hearing. The certificate holder may further appeal the revocation before the city commission. Within ten (10) days of the receipt of notification of final determination from the building official, the certificate holder may file a written request for hearing before the city commission with the city clerk's office. The matter will be placed on the next available agenda to be heard before the commission. The decision rendered by the commission shall be considered final.
