§ 17-01A-030. Investigation of applicant.

  • Upon the receipt of an application for a business license, the clerk shall require an investigation of the applicant, to protect the public health, safety and welfare, and refer the application to the appropriate investigating officer. The investigating officer shall make a report on the application, favorable or unfavorable, within ten (10) days of receiving the application. If, as a result of the investigation, the city clerk determines that the issuance of a business license is not in the interest of the health, safety and general welfare of the public, the application shall be referred to the city commission for hearing and issuance or denial of a license. Before the hearing, the applicant shall be given notice and at the hearing shall have an opportunity to be heard before the city commission. The city commission may also hear any other evidence presented on the matter. If, upon hearing, a majority of the city commission present at the hearing determine that issuance of the license is not in the best interest of the public health, safety or welfare, the license may be refused.
