§ 20-02-030. Authority.

  • (a)

    The city planning and zoning commission shall have power and authority to study and investigate the subject of municipal planning and zoning, for the purpose of the formulation of a master plan, and shall make such surveys as it deems necessary for the formulation of such a master plan for the city; and in this connection the city planning and zoning commission shall have power and authority to hold public hearings for the formulation of such master plan. After the master plan has been approved, and within the area of the master plan, the planning and zoning commission shall recommend to the city commission the approval or denial of any proposal to construct, accept, widen, narrow, remove, extend, relocate, vacate, abandon, acquire, or change the use of any:

    (1)

    Park, street, or other public way, ground, place or space;

    (2)

    Public building or structure; or

    (3)

    Utility, whether publicly or privately owned.

    (b)

    The city planning and zoning commission shall have power and authority to call before it the city manager, and any and all department heads and officers and employees of the city, who shall at the request of the commission furnish such commission such data, information and reports as such commission may request.

    (c)

    The city planning and zoning commission shall, from time to time, as it sees fit, make recommendations to the city commission for the passage of ordinances which it may deem advisable.

    (d)

    The city planning and zoning commission shall file an annual report with city manager and city commission of its activities, meetings and progress.

    (e)

    The city planning and zoning commission shall have such other powers, authority and jurisdiction as may be from time to time delegated to such commission by ordinance or by resolution of the city commission.
