§ 29-01-100. White Sands beautification district.
(a)
Zoning district map amendment. The official city zoning district map is amended by the addition of the White Sands corridor overlay district ("White Sands district") classification to the properties in the vicinity to the White Sands Boulevard. The extent and limits of the White Sands corridor overlay district are generally depicted in the White Sands corridor maps appended to this ordinance. In the event of a discrepancy between the White Sands corridor map and the official zoning district map, the latter shall control. When the requirements of the White Sands corridor overlay district are in conflict with those of the underlying district, the more restrictive limitation or requirement controls. The underlying zoning district classification of properties within the White Sands corridor overlay district is unchanged by this map amendment.
(b)
General provisions. The purposes of the White Sands district are:
(1)
The beautification of the White Sands district through a citizen-based, volunteer, grassroots effort; and
(2)
The establishment of a master plan to guide the city's efforts towards beautification, anti-blight and economic development of the White Sands district; and
(3)
The development of regulations for the White Sands district consistent with the master plan;
(4)
The identification and utilization of available funding, donations and grants for the beautification of the White Sands District consistent with the approved master plan and regulations enacted pursuant to it; and
(5)
The review, approval and/or denial of improvement projects within the White Sands district consistent with the master plan and regulations enacted pursuant to it; and
(6)
The review, approval and/or denial of all applications for new construction, exterior alteration and change of use in the White Sands district consistent with the master plan and regulations enacted pursuant to the master plan.
(c)
Minimum maintenance requirements. All buildings and structures in the White Sands corridor overlay district shall be preserved against decay and deterioration and free from certain structural defects in the following manner, by the owner thereof or such other person or persons who may have the legal custody and control thereof. The owner or other person having legal custody and control thereof shall repair such building or structure if it is found to have any of the defects identified in the approved master plan and regulations enacted pursuant to it requiring such repair.
(d)
Compliance with general and specific design standards required. All development located within the White Sands district shall comply with all applicable general development standards consistent with the approved master plan and regulations enacted pursuant to it.
(e)
General design standards for the white sands corridor overlay district. In any review of proposed additions or alterations to structures located in the White Sands corridor overlay district, the standards of the approved master plan and regulations enacted pursuant to it shall be complied with. Such standards shall include, but not limited to the following:
(1)
Architectural style, including:
a.
Materials; and
b.
Color; and
c.
Roof form. Slope and shape.
(2)
Streetscape standards.
(3)
Signs; murals.
(4)
Walk areas.
(5)
Size, mass and shape.
(6)
Walls and fences.
(7)
Remodeling and alteration.
Persons requesting approval of any application for the construction, or remodeling or alteration of nonconforming structures located in the White Sands district shall not be required to bring the total structure into conformance with the standards for the White Sands district. However, the portion of the building that is remodeled or altered shall conform to those standards. "Related to and compatible with" means existing together with unity and coherence.
