§ 8-08-190. Grounds for termination of water service.

  • (a)

    Not withstanding any other provisions of this Article, in the event a system hazard is determined to exist; the building code division shall immediately terminate water service to the premises. The city shall attempt to notify the customer of the water service termination to the premises and of the system hazard in the premises. The city shall restore water service to the premises once the customer has controlled or eliminated the system hazard.

    (b)

    Failure to install required backflow prevention assembly(ies) as directed by the building code division, failure to conduct required tests, failure to submit accurate and timely reports, failure to perform testing and maintenance of backflow prevention assemblies, or failure to allow the building code division entry into a premises shall constitute grounds for termination of water service to the premises. Service shall not be restored until such conditions or defects are corrected. If water service is terminated for any of these reasons, a turn off and turn on water service fee will be assessed to the customer as per the requirements of city ordinance governing water, sewer rates.

    (c)

    The city may terminate water service for nonpayment of the fees included in this article in accordance with the provisions of the city ordinance governing water, sewer rates.
