§ 11-05-320. Generally—Sale of tobacco products—Minors.

  • It shall be unlawful for any person, sole proprietorship, partnership, corporation or other business entity to sell or distribute a tobacco product:

    (1)

    To any individual known to be less than eighteen (18) years of age; or

    (2)

    To any individual who does not present a drivers license or other generally accepted means of identification which describes that individual as being eighteen (18) years of age or older, contains a photographic likeness of the individual and appears on its face to be a valid form of identification.
