§ 2-13-340. Definitions; authorizations; multi-term contracts.

  • (a)

    Definitions. For the purpose of sections 2-13-360, 2-13-350, 2-13-360, 2-13-370, 2-13-380 and 2-13-390, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

    Construction management at-risk means a project delivery method in which the city awards separate contracts, one (1) for architectural and engineering services to design a public infrastructure facility and the second to a construction manager at-risk for both construction of the public infrastructure facility according to the design and construction management services.

    Design-bid-build means a project delivery method in which the city sequentially awards separate contracts, the first for architectural or engineering services to design a public infrastructure facility and the second for construction of the public infrastructure facility according to the design.

    Design-build means a project delivery method in which the city enters into a single contract for design and construction of a public infrastructure facility.

    Design-build-finance-operate-maintain means a project delivery method in which the city enters into a single contract for design, construction, finance, maintenance, and operation of a public infrastructure facility over a contractually defined period.

    Design-build-operate-maintain means a project delivery method in which the city enters into a single contract for design, construction, maintenance, and operation of a public infrastructure facility over a contractually defined period.

    Design-build contract means a contract between the city and a design-build entity to furnish the architecture, engineering, and related services as required for a given public infrastructure facility project, and to furnish the labor, materials and other construction services for the same project.

    Design-build entity means the entity (whether a natural person, partnership, joint venture, corporation, business association, or other legal entity) that proposes to enter into a design and build, design-build-operate-maintain, or a design-build-finance-operate-maintain contract. This entity shall be able to provide appropriately licensed contracting, architectural, and/or engineering services as required by the request for proposals.

    Proposal means an offer to enter into a design-build contract by a design-build entity in response to a request for proposals.

    Public infrastructure facility means any public structure, public building, or other public improvements of any kind which is used to provide a public service such as water and sanitary sewer services, flood protection, transportation services, solid waste, parks and recreational, and fire or police services.

    (b)

    The following project delivery methods are authorized for procurements relating to construction of any public infrastructure facility:

    (1)

    Design-bid-build;

    (2)

    Construction management at-risk;

    (3)

    Design-build;

    (4)

    Design-build-operate-maintain; and

    (5)

    Design-build-finance-operate-maintain.

    (c)

    Multi-term contracts for operation and/or maintenance. Notwithstanding section 2-13-200, a multi-term contract for the operation and maintenance of a public infrastructure facility procured through either the design-build-operate-maintain or design-build-finance-operate-maintain project delivery methods may be entered into for any period of time deemed to be in the best interests of the city but not to exceed twenty (20) years.
